Dysart Taylor is pleased to announce director John F. Wilcox, Jr. and of counsel attorney Anne Lindner Saghir obtained summary judgment for their client, a state transportation department, in a personal injury case involving a motorcycle crash.

In 2018, the plaintiff was involved in a motorcycle crash while entering a truck stop/gas station. The plaintiff’s motorcycle was struck by a work truck in the process of leaving the property, and then he sued the truck stop, its employee driver and the department of transportation.

The Dysart Taylor team defended the transportation department against claims of negligent design and maintenance at the station. Specifically, the motorcyclist claimed the department failed to ensure the driveway throat length leading from the highway provided for an adequate space for incoming and outgoing traffic that eventually caused or contributed to cause the accident.

Wilcox and Saghir successfully defended their client by establishing that it did not own or exercise control over the area where the accident occurred. In January 2022, the Circuit Court judge agreed and granted Wilcox and Saghir’s motion for summary judgement, ruling that as a matter of law, none of the exceptions to sovereign immunity were applicable.
